Terms of Service – Empire Card

Welcome to Empire Card

These Terms of Service (“Terms”) govern your access to and use of the Empire Card platform, including our website (empirecard.org), mobile application (Android/iOS), and related services.

By accessing or using Empire Card, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our services. Empire Card Entertainment Inc. provides these services to you subject to the conditions set forth below.

1. General Access Guidelines

1.1 Eligibility

To access Empire Card, you must be at least 21 years of age or the legal age of majority in your jurisdiction, whichever is higher. By using the platform, you represent and warrant that you meet this age requirement.

1.2 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials (username and password). You agree to accept responsibility for all activities that occur under your account.

  • One Account Policy: Users are permitted only one active account. Duplicate accounts may be suspended for security review.
  • Security: You agree to notify Empire Card Support immediately of any unauthorized use of your account or any other breach of security.

2. Platform Usage Rules

2.1 Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the platform in any way that violates any applicable local (Philippine) or international law or regulation.
  • Attempt to interfere with the proper working of the platform, including overloading the system (DDoS attacks) or introducing viruses/malware.
  • Use any robot, spider, or other automatic device to access the platform for any purpose, including monitoring or copying any of the material.

2.2 Device and Network Usage

Empire Card is optimized for mobile devices. While we strive for stability across all networks (LTE/5G), we are not responsible for:

  • Data charges incurred from your mobile network provider (Globe, Smart, DITO).
  • Connection timeouts or interruptions caused by local ISP fluctuations or “dead spots.”
  • Performance issues resulting from the use of incompatible or outdated devices.

3. Transactions and Payments

3.1 Processing

All transactions are processed through third-party payment gateways (e.g., GCash, Maya, Banks). By initiating a transaction, you agree to the processing times and terms outlined in our Payment Tips.

3.2 Accuracy

You are responsible for providing accurate payment details. Empire Card is not liable for funds sent to incorrect account numbers due to user error.

3.3 Verification

We reserve the right to request identity verification documents before processing certain requests to comply with anti-money laundering (AML) standards and ensure account security.

4. Intellectual Property

The content, features, and functionality of the Empire Card platform—including but not limited to the “Card-First” interface design, text, graphics, logos, and software—are owned by Empire Card Entertainment Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of the material on our platform without prior written permission.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Empire Card Entertainment Inc., its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from:

  • Your access to or use of or inability to access or use the platform.
  • Any conduct or content of any third party on the platform.
  • Any content obtained from the platform.
  • Unauthorized access, use, or alteration of your transmissions or content.

6. Modifications to Services and Terms

We reserve the right to withdraw or amend our platform, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of the platform is unavailable at any time or for any period.

We may revise and update these Terms from time to time. Your continued use of the platform following the posting of revised Terms means that you accept and agree to the changes.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
